Terms of Service

CUSTOMERS - TERMS OF SERVICE

This Terms of Service agreement ("Agreement") is a legally binding contract between Studentutor ("Company") and the customer ("Customer") who wishes to receive tutoring services through the Studentutor platform. By using the services provided by Studentutor, the Customer agrees to be bound by the terms and conditions outlined in this Agreement.

  1. Tutoring Services
    1.1 Studentutor is an online platform that connects highly qualified student tutors with students seeking academic tutoring services.
    1.2 The Company shall use reasonable measures to ensure that all tutors provided through its platform have achieved high academic marks in their respective fields of study.
    1.3 The Customer may request tutoring services for specific subjects or academic areas, and the Company will make reasonable efforts to match them with an appropriate tutor.

  2. Payment
    2.1 The Customer agrees to pay Studentutor for the tutoring services provided, based on the agreed-upon hourly rate.
    2.2 The hourly rate for tutoring services shall be £20, payable to Studentutor.
    2.3 The payment shall be made through the designated payment methods specified on the Studentutor platform.

  3. Relationship between Customer and Tutor
    3.1 The Tutor provided by Studentutor shall act as an independent contractor and not as an employee or agent of the Company.
    3.2 The Company assumes no liability for the actions, conduct, or performance of the Tutor during tutoring sessions.

  4. Cancellations and Refunds
    4.1 The Customer may cancel a scheduled tutoring session by providing 24 hours notice to Studentutor.
    4.2 In the event of a cancellation by the Customer, refunds shall be subject to the refund policy specified on the Studentutor platform.

  5. Session Recordings and Quality Control

6.1 All online tutoring sessions conducted through the Studentutor platform shall be recorded by the tutor.

6.2 The Tutor shall inform the Customer at the start of each tutoring session that the session is being recorded for quality control purposes of the tutor.

  1. Intellectual Property
    5.1 All intellectual property rights pertaining to the tutoring materials and content provided by the Tutor during the tutoring sessions shall remain with the Tutor or the rightful owner.
    5.2 The Customer agrees not to reproduce, distribute, or use any tutoring materials or content provided by the Tutor for any commercial purposes without obtaining prior written consent.

  2. Limitation of Liability
    6.1 Studentutor shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to the use of its services.
    6.2 The maximum liability of Studentutor, whether in contract, tort, or otherwise, shall not exceed the total amount paid by the Customer for the specific tutoring session in question.

  3. Governing Law and Jurisdiction
    7.1 This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.
    7.2 Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

TUTORS - TERMS OF SERVICE

 

This Terms of Service agreement ("Agreement") is a legally binding contract between the tutor ("Tutor") and Studentutor ("Company") regarding the provision of tutoring services through the Studentutor platform. By providing tutoring services through Studentutor, the Tutor agrees to be bound by the terms and conditions outlined in this Agreement.

 

Relationship with the Company

1.1 The Tutor agrees to provide tutoring services to Students referred by Studentutor.

1.2 The Company shall pay the Tutor a fixed rate of £15 per hour tutored, subject to the terms and conditions outlined in this Agreement.

 

Tutoring Services and Responsibilities

2.1 The Tutor shall provide tutoring services in a professional and competent manner, drawing upon their expertise and knowledge in the respective academic field.

2.2 The Tutor acknowledges that they are an independent contractor and not an employee or agent of the Company.

2.3 The Tutor shall adhere to any guidelines, policies, or standards set forth by the Company regarding the provision of tutoring services.

 

Payment

3.1 The Company shall pay the Tutor the agreed-upon rate of £15 per hour tutored.

3.2 Payment shall be made in a timely manner, according to the payment schedule and method specified by the Company.

3.3 Payment to the Tutor from Studentutor is only eligible once the Company receives the screen recorded video of the tutoring session.

 

Promotion and Marketing

4.1 The Company shall make reasonable efforts to publicize the Tutor's expertise and qualifications to potential Customers in an equitable manner.

4.2 The Tutor grants the Company the right to use their name, image, and relevant information for promotional purposes on the Studentutor platform or other marketing channels.

 

Confidentiality

5.1 The Tutor agrees to maintain the confidentiality of any proprietary or sensitive information shared by the Company, including but not limited to customer details, tutoring materials, and business strategies.

 

Session Recordings and Quality Control

6.1 All online tutoring sessions conducted through the Studentutor platform shall be recorded by the tutor.

6.2 The Tutor shall inform the Customer at the start of each tutoring session that the session is being recorded for quality control purposes.

6.3 The recordings are exclusively for quality control purposes and are mandatory. Quality control pertains to the Tutor's performance and does not include the evaluation of the Student's performance.

 

Termination

7.1 Either party may terminate this Agreement with written notice to the other party.

7.2 Upon termination, the Tutor shall be entitled to compensation for tutoring services rendered up until the effective termination date.

 

Intellectual Property

8.1 The Tutor represents and warrants that they have the necessary rights to any tutoring materials, content, or intellectual property provided to the Students during tutoring sessions.

8.2 The Tutor grants the Company a non-exclusive, royalty-free license to use, reproduce, and distribute any tutoring materials or content shared with the Students through the Studentutor platform for promotional or educational purposes.

 

Governing Law and Jurisdiction

9.1 This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom.

9.2 Any disputes arising from or related to this Agreement shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

 

By providing tutoring services through the Studentutor platform, the Tutor acknowledges that they have read, understood, and agreed to be bound by this Terms of Service agreement.
